VOTE YES ON AMENDMENT 4.11

Per the Miami Herald article from January 12th, 2023 Amendment 4.11, if passed  "would transfer the power over zoning code changes from elected officials to voters."

VOTING YES WILL RESTORE POWER TO THE RESIDENTS

SPECIAL ELECTIONS WOULD ONLY BE REQUIRED FOR OVERALL VILLAGE ZONING AND LAND USE CHANGES

Special interest groups will need to convince 60% of the voters versus only 5 councilmembers. Voting YES returns the power to the residents.

The Council recently approved adding +/- 1500 apartments, increasing traffic by an estimated 2500 additional cars in Pinecrest.  (read the Vision Plan - the zoning changes - Comprehensive Plan Amendments)

  1. Voting YES DOES NOT affect a building permit for your driveway, moving your fence, etc.
  2. Voting YES DOES NOT change Variances or Conditional Use Permits (if you need a variance on your home project the council can grant it)
  3. Cell phone towers are being installed all over Pinecrest in the right of way and not on residents’ property. AT THE SOLE DISCRETION OF CELL PHONE PROVIDERS; OUR COUNCIL APPROVED THAT.
  4. AirBNBs are allowed in Pinecrest because past Council and former Mayors never outlawed them. Now AirBNBs are regulated by Tallahassee and we are now stuck with them.
  5. Key Biscayne residents have been voting on their land development regulations, zoning since 2007;  THEIR VILLAGE HAS BEEN PRESERVED BY RESIDENTS NOT THE POLITICIANS.


Our building codes are set to allow large homes with mixed architectural styles with few design requirements or limitations.   Under Amendment 4.11 Splitting large parcels is still allowed and does not require a zoning change or a special election.

    Why THE PETITION & what's amendment 4.11?

    Petitions CERTIFIED to VOTE on Amendment 4.11 to PROTECT OUR QUALITY OF LIFE

    This Petition was initiated because:
     

    • Pinecrest incorporated to control our zoning and our mayor HAS IGNORED THE RESIDENTS THAT OPPOSE adding Apartments, adding Parking Garages and Increasing our Density
    • Our mayor and council refuse to listen to the residents
    • Residents no longer trust our elected representatives with our ZONING
    • Residents want to vote on ZONING to PROTECT OUR QUALITY OF LIFE

    What is Amendment 4.11?

    Under Article 4 titled, Legislative we are adding one additional amendment section 4.11 titled:


    “Approval by Vote of Electors Required for Amendments to Land Development Regulations”.


    “No text amendment to the zoning code or other land development regulations that would create a new zoning district, or that would amend any definition of a term used in the land development regulations, or that would have the effect of allowing a use not currently permitted, increased residential density, additional hotel or other accommodation units per acre, or increased lot coverage, height, or floor area ratio, shall be effective until approved by 60% of the electors voting on the amendment.”

    Protecting our Zoning to Protect our Quality of Life

    If successful Amendment 4.11 will change our charter allowing residents to vote on future zoning and land development regulations.  


    By changing the law, residents will protect the Village regardless of future mayors and future elected council members that have a different "Vision" for Pinecrest. 


    Amendment 4.11 puts the power back in the hands of the residents.  It's our Village & we should vote on future zoning changes that will impact our quality of life for generations to come.


    Our goal is to keep Pinecrest the way it is.
