MORE LIES FROM OUR VILLAGE - WHY ARE THEY SO DESPERATE ?

VISION PLAN FOR US1 INCLUDES ADDING 1273 NEW APARTMENTS, INCREASES BUILDING HEIGHTS & INCREASES DENSITY.  WHY ARE THEY SAYING THE OPPOSITE?  READ THE PLAN


  1. ”Council has not proposed any height or density changes”- FALSE!  “Vision Plan” ADDS 1273 APARTMENTS, increases heights & adds density.  (Vision Plan) READ THE PLAN! 
  2. County’s proposed RTZ Ordinance allows “Village to preserve all single family homes”- 50 acres of US1 forced to be rezoned- We pay MILLIONS in County taxes & now they want OUR LAND!
  3. Our petition “encourages developers to seek variances rather than zoning changes”- FALSE!  OUR PETITION DISCOURAGES high-density development, where variances will continue to exist to help residents.  Mayor on record that he can “increase building heights by granting variances”. EXPLOITING HIS POWER!
  4. Our petition ”gives disproportionate power over zoning” – 100% FALSE- our petition puts zoning changes to a vote by the people.  Why are they being so forceful to keep their power? 


There’s NO GUARANTEE from future encroachment by the County.  We need to stop them now.

Why is Pinecrest not following Palmetto Bays leadership to oppose the County’s forced rezoning of US1?

Why THE PETITION & what's amendment 4.11?

2,005 registered voters have Signed our Petition to VOTE on Amendment 4.11 to preserve Pinecrest

This Petition was initiated because:
 

  • Pinecrest incorporated to control our zoning and our mayor supports the county's plan that forces rezoning of our commercial corridor
  • Our mayor and council refuse to listen to the residents
  • Residents no longer trust our elected representatives with our ZONING
  • Residents want to vote on ZONING to keep Pinecrest the way it is now

What is Amendment 4.11?

Under Article 4 titled, Legislative we are adding one additional amendment section 4.11 titled:


“Approval by Vote of Electors Required for Amendments to Land Development Regulations”.


“No text amendment to the zoning code or other land development regulations that would create a new zoning district, or that would amend any definition of a term used in the land development regulations, or that would have the effect of allowing a use not currently permitted, increased residential density, additional hotel or other accommodation units per acre, or increased lot coverage, height, or floor area ratio, shall be effective until approved by 60% of the electors voting on the amendment.”

Protecting our Zoning for Future Generations

If successful Amendment 4.11 will change our charter allowing residents to vote on future zoning and land development regulations.  


By changing the law, residents will protect the Village regardless of future mayor's and future elected council members that have a different "Vision" for Pinecrest. 


Amendment 4.11 puts the power back in the hands of the residents.  It's our Village & we should vote on future zoning changes that will impact our quality of life for generations to come.


Our goal is to keep Pinecrest the way it is.

COUNTY WANTS US1 rezoned to FORCE apartments

PROPOSED ORDINANCE USURPING OUR ZONING LAWS NOW DEFERRED

On June 1, 2022 at the County Commissioners meeting the first reading took place on the updated proposed ordinance #221198 (Agenda Item 4B).  


11 commissioners were present and 3 VOTED AGAINST it with 2 commissioners voting "YES FOR NOW” which some could interpret as a possible future NO as well.     


  • VOTED YES FOR NOW -  Sosa (District 6) & Higgins (District 5). 
  • VOTED NO - Cohen-Higgins (District 8), Martinez (District 11) & McGhee (District 9)  
  • ABSENT - Our representative, Commissioner Regalado (District 7) was absent for the vote. Although she was present during the roll call, she was absent from the chamber missing her opportunity to vote on the proposed ordinance.

PARTICIPATION AT THE IN-PERSON TOWNHALL WAS HUGE & IMPACTFUL. 

 

100’s OF RESIDENTS ATTENDED AND WERE HEARD! 


TAKE AWAYS: 

  • OVERWHELMING opposition to increased density.
  • OVERWHELMING opposition to proposed increases to our building height from our current 4 to the proposed 8 stories in some areas. 
  • DOUBLE DIGIT population growth of +/-20%
  • Residents asked the mayor to put this plan on HOLD.  
  • Too many questions & unknowns.


These radical changes could impact our Village and potentially be irreversible.


NEXT STEPS


On MONDAY January 31st at 11am our Council will workshop the Updated DRAFT to the Pinecrest Parkway Vision Plan (US1) to discuss what to keep, what to edit and what to remove.

WHAT'S IN THE DRAFT PLAN FOR US1?


  • RESIDENTIAL & NEW BUILDING HEIGHT LIMITS WILL BE ADDED TO US1 - Residential Zoning and Density changes will be added to US1 despite the polling results of the previous Inspire workshops where 75% of residents said NO to adding residential to US1.  
  • NEW building height limits are proposed to be increased from our current 4 stories to up to 8 stories on SW 104 St and SW 136 St ( Our current height limit is 4 stories or 45 feet).  Additionally NPBAD Zoning District which already includes Mixed-Use with Residential is to be expanded.  
  • INCREASES TO DENSITY -  Pinecrest Council will be adding density to 25 units per acre.  Our Comprehensive Master Plan suggests a maximum of 25 units per acre but Council discussed 30 units per acre at the last workshop.  Our Mayor and Council explained that 30 units per acre meets the Federal Funding requirements that supports Transit Oriented Development to create Ridership for the Bus Rapid Transit or the RTZ.  These changes will require an update to our Comprehensive Master Plan.
  • What's the Impact?  a potential of +/- 1300 NEW residential units on the US1 corridor.   That would mean a population increase of +/- 3600 residents* or +/- 20% (*estimated as households with 2.8 members)


Here are some Unknowns that have been shared by Residents:  

  • Why is Village Staff recommending adding Residential if Residents polled don't want it?
  • Are our elected representatives caving to County pressure to add Density to create the needed bus ridership for the RTZ?
  • How will these changes improve our Quality of Life?
  • How will our Infrastructure handle this potential growth?
  • What about our Schools, Fire, Police, Flooding, Sewer, Water, & Congestion?
  • What is the Environmental Impact?
  • What about the added TRAFFIC & NOISE?


According to our Mayor these unknowns/issues are managed once Development plans are presented.

  • NOW BANNED ALL GAS POWERED LEAF BLOWERS effective January 2023.  ALL RESIDENTS &  Commercial Lawn Service companies will NOT be allowed to use ANY gas powered leaf blower regardless of decibel level.  In addition there is a ban on ANY electric leaf blower higher than 65 decibels.

  • PASSED RESOLUTION - SAO Agreement Authorizing the Village Manager to enter into an agreement with the STATE ATTORNEY'S OFFICE (SAO) for prosecution of certain criminal violations of the Pinecrest Code of Ordinances and to reimburse the STATE for costs.  Read the SAO 
  • PROJECTED POPULATION GROWTH  - The presentation of the DRAFT Master Plan for Parks & Recreationincluded Demographic Data showing an increases to our population through the year 2030 with +/- 21,000 residents (13.5% increase) vs. our current +/- 18,500.  Based on the last 2 US Census Reports, Pinecrest's population has not fluctuated much from current numbers. 


So where's this anticipated population growth expected to come from? 

According to the plan's presenter, this data is based on a "source of reliable information"  and was presented based on "Miami-Dade County's projections for the Village, in terms of the 2030 population, has been used by the Village and supported...for that population potential".  He adds that the population growth would require zoning changes along the US1 corridor.

  • Miami-Dade County reps presented an UPDATE on the BRT & the "South Dade TransitWay Design-Build Overview". Construction of 2 new Bus Terminals/Vestibules on SW 104 St. & SW 136 St. will begin Summer 2022 with estimated completion date in 2023.
  • Gate Arms will be installed stopping traffic on the East/West cross roads covering approximately 46 intersections along US1.
  • NO additional parking for the new Bus Terminals/Vestibules on SW 104 St or SW 136 St.
  • SECURITY - Residents asked what type of security will be added to the new Terminals/Vestibules and how will the County manage potential increases in overnight loitering and vagrancy.  Miami-Dade reps confirmed the County's current plan to use "security cameras at each facility that will be monitored" but there is no confirmation on adding security officers at this time. They also acknowledged that by adding vestibules "people might stay" overnight but part of the County's security is to control "that situation".
  • Commissioner Regalado (District 7) is working on the possibility of adding Pedestrian Cross Bridges along the corridor.


  • UPDATE on County’s Proposed Ordinance by Commissioner Gilbert (District 1) which could see an UPDATED PROPOSED ORDINANCE in mid January 2022.  Potential INCREASES to 150 units/acre - 859% population INCREASE.

  • Residents that missed the Virtual Inspire Part 1 or Part 2 participated in an IN PERSON Q & A Townhall with our Village Manager and Mayor Corradino.  


  •  The Q&A transitioned into a presentation focused on the future recommendations for the US-1 corridor that will be made by our Village Manager and Staff to our elected officials in January 2022.


  •  Staff stated that they are considering CHANGING the ZONING along US-1 to include Residential in the event that our County Commissioners pass a proposed Ordinance that includes incorporated cities, like Pinecrest losing control of their zoning to promote high density development for the new BRT. 


  • According to Staff,  our County Commissioners expect municipalities to include NEW ZONING that supports Transit Oriented Development within a 1/2 mile EAST of US1/SW 104 St and SW 136 St where NEW TICKET TERMINALS are planned.


  • Staff reminded residents that in Pinecrest the Northern US-1 corridor CURRENTLY allows for Mixed-Use Commercial with Residential (with a max of 4 stories or 45 ft).  


  • Our Manager and staff is recommending that Zoning allowing Residential units be added to the Southern part of our commercial corridor including the lot located at SW 136 St.


Despite the results of the polled residents during the first townhall, where 75% do not want to add residential units to the commercial corridor,  it appears that staff will recommend to ADD residential.  Staff also requested input from the community on this idea. Email your comments to Staff.
